Considering that he has been charged with the lowest grade of charge it's a bit rich, legally, to suggest that you can't rely on instances the next rung down (ie uncharged incidents) as opposed to every other charge which can rely on other examples to reduce the seriousness.

If JWH had collected him in the throat than macqueen would have been seen immediately clutching at his throat with terrible breathing difficulties, and this did not happen by macqueen.
