There were a few cases of Sydney Train and Bus drivers being sacked for failing random drug and alcohol testing but were reinstated by the Fair Work Commission as their employer didn't offer them drug and alcohol dependency counselling. - Not only reinstated but awarded compensation.

It needs to be remembered that Victor has not failed a drug test to the public's knowledge and nor was he caught in possession of any illegal drugs to the public's knowledge so I really don't see how the club can terminate his contract for seeking out a drug.

I agree with what you say Sam he’s not guilty of anything, he won’t get terminated, I don’t want to see him gone from the club, however I would have him on a tightrope from here on in, take all the measures to educate him even though at 27 he should have have pulled his head in by now.
Sacked from the leadership group, I’d ban him from the piss too if he’s serious about learning from this he will agree and perhaps we will see the best version of Rads.

Totally agree with you here mate he's surely got to wake up to himself and realise that a night of cocaine isn't worth throwing away a top level footy career right when you're in your prime and making good money living a comfortable life.

The thing is kakaruk Victor is a risk taker & thats his personality & its probably what attracted his partner to him.
I would go so far to say that his GF/wife has also dabbled in the same thing Victor does & that they still function like any other couple with a young family.

Depending if there are any terms and conditions are in Victor’s contract regarding bringing the club into disrepute or the like, it may well be that the club will not be able to terminate the contract without a negotiated payout, possibly up to the remaining two years. He’s not a full-time permanent employee, but on a fixed-term contract, so his remaining $1.3m contract value will be the key issue. He wouldn’t be covered by FWA unfair dismissal provisions due to the size of his remuneration; that cuts off at $183k. He certainly would have civil remedies he could pursue.

What’s legal vs what’s practical should be what Victor focuses on though. If Nick digs his heels in regarding his zero tolerance stance, the smartest thing Victor could do is to negotiate a deed of release for a mutually agreed sum, otherwise Victor might find himself sitting on the reserves bench in NSW Cup for two years, which would be quite damaging to his career. He’s still only 27, so maybe take some free cash now and restart his career elsewhere. I wouldn’t be surprised if Souths made a play for him if he does go.

What transpires in Smith’s court appearance is almost irrelevant; if the boss wants him gone, he will be gone in one form or the other.

It will be fascinating to see whether Nick back tracks or not. He wants to leave a legacy that he’s proud of, so my guess is not. That will be a sad day all round.
