In my Department - NSW Department of Education (DoE) the following applies
Under the Public Health (COVID-19 Vaccination of Education and Care Workers) Order 2021 the NSW Government has mandated that people who work in or visit government schools and early childhood education (ECE) sites are legally required to have received two (2) doses of a COVID-19 vaccine or to have provided a medical contraindication certificate to the department.
Only staff who are fully vaccinated and can provide evidence of this will be able to come onto school sites from 18 October 2021 (where staff are required to support the staged return to school under Level 3 plus) or from 8 November for all other schools and ECE sites.
If you have not completed the online declaration by 22 October 2021 you will be contacted again about your legal obligations in the week beginning 25 October 2021.
NSW Teachers Federation have had a significant number of their members resign due to alleged non action on the issue of mandatory vaccinations - basically if mandated vax employees are not fully vaccinated or refuse to be vaccinated their employment could well be terminated
At least 10% of NSW Department of Education staff have indicated in a Department wide survey they do not plan to be vaccinated which is around 10,000 employees- 6000 or so of these Teachers.
Be interesting to see if these 6000 or so Teachers continue with their plan not to be vaccinated as this will cause significant issues in Schools already short of Teachers - classes of 45 plus students being considered plus the Teachers Federation's award expires in December and like Oliver Twist they are asking more than the fixed 2.5% Public Sector pay rise ( 2.04 % salary and 0.50% Superannuation Guarantee increase).
The legality of Mandatory Vaccinations is before the NSW Supreme Court - final submission were heard on 7th October 2021- so a ruling is pending
