  • SKD in hospital

SYDNEY Roosters star Shaun Kenny-Dowall has been admitted to hospital after undertaking a mental health assessment.

Kenny-Dowall was due to appear in Waverley Local Court on Thursday on 10 domestic violence charges, including six counts of common assault, one count of assault occasioning actual bodily harm and stalking/intimidating his former partner, Jessica Peris.

The Daily Telegraph understands Kenny-Dowall was admitted to hospital on Tuesday, in a joint decision made by concerned Roosters officials and his family. The decision was made as a precaution because of the club’s concerns about his wellbeing.

A source has told The Daily Telegraph Kenny-Dowall has been not himself and had gone into his shell since his former partner applied for an apprehended violence order against him last ThursdayThe 27-year-old has been given time off by the Roosters and wasn’t considered for selection for Friday night’s clash against the Wests Tigers.

He was also rested from last Sunday’s 24-0 win over the New Zealand Warriors.

Speaking on Sterlo On The Couch on Fox Sports on Wednesday night, Roosters coach Trent Robinson described Kenny-Dowall as “being in a dark place’’.

While he was not asked specifically about Kenny-Dowall being admitted to hospital, Robinson said: “I’ve had many chats with Shaun (over the past few weeks).

“It’s a tough period for him at the moment. He’s in a bit of a dark place.“He’s not in a good enough state to get out there and play.”

His teammates, including co-captain Jake Friend, said it was important Kenny-Dowall put health before football.

“I’ve sent him a message, and he’s doing it pretty tough,’’ Friend said.

“He knows we’re all supporting him, he’s having time to himself to get his head right, and hopefully in the next few weeks he’ll be back around the office and into the footy again.

“We’re hoping Shaun is back into training and playing as soon as possible, but his frame of mind and his health is first and foremost, and footy doesn’t compete with that.’’
Another Roosters’ player Boyd Cordner, said he had also reached out to Kenny-Dowall via text, and was only worried about his well-being.

“He needs some time to be around his family at the moment, we support that, and whenever he’s ready to come back, we’ll welcome him with open arms,’’ Cordner said.

“This club has been through a bit in the past, but at this present time, he’s a good mate, and we’ll support him all the way.’’

Teammate Brendan Elliot was given the call-up at the last minute, and retains his place on Friday night.

“Brendan was told the day before the game he would be playing, and for him to come in and play the way he did, the boys really respect and trust him on the field,’’ Friend said.

    Wow really tough stuff..

I don't think I'm alone in believing in your innocence.

You definitely aren't. I believe he is as well. I dont know what to expect if he isn't though. That's a scary thought.

Yep. Goes down tommorow. If found guilty is SKD a chance of going to jail? 10 offences are huge.

The hardest thing is that SKD will plead not guilty and then it will be adjourned till a later date.
For SKDs mental state this won't be good. Fingers crossed that charges are dropped

I'm not sure they can be dropped without a court procedure. You cannot get a little bit pregnant after you sign the dotted line. Chin up Shaun.

I tell you. Unless this turns out to be true, a lot of people are going to be sued. Starting with our illustrious premier. And I think a revue of Sportsline tonight on Sky wouldn't go astray.

If the police have definitive evidence, to go along with the victims statement, then they can proceed without the victims support as it's a domestic. That was brought in due to the amount of women that backed out due to fear.

But if there is little to no proof to support the victim statement and the victim retracts the statement, then yes they can apply to drop the charges.

And no, I doubt he would go to jail.

As I think I wrote, even if they think there's no evidence police charge suspects in domestics so they don't get the wrath of the White Ribbon brigade on them. The last thing they want is to make a cockup and have a dead woman or kid, especially after the Batty kid screw up.

If SKD is found not guilty on any of the charges can Peris be sued for false allegations?

                          Chook.

All he'll be doing is pleading though... then they'll schedule a date for his hearing. This will probably be in a few months time.

IMO not really. You'd need to find an appropriate tort and there's no real 'tort of reporting false allegations'. The cops look at allegations on their merits and decide whether to proceed, so do they prosecutors, so there are checks and balances. You can't really sue the cops/prosecutors for following up on allegations of DV and making an honest mistake.

FWIW it couldn't be a tort of defamation against her or the papers either (if people were thinking that) because she hasn't published anything and all the stuff that the papers have published is true (i.e. the cops have laid 10 charges against him). Maybe he can sue the Premier for saying things on top of that (in the media) and making it a bigger issue before it has even been heard but ya... good luck calling the premier into court and saying he's after you.

                              Tough world ay?

Costs... maybe? However, they wouldn't be against her because the prosecutors will be the other party in the matter.

All I can think is that a not guilty finding might help him in the family court later on if it goes there. In the family court you can't be punished for making allegations of DV (this used to be the case but they got rid of it because slick lawyers were making DV victims look stupid because they couldn't prove the DV, so they got a smaller share of the pie and were often penalised for being unable to prove every little bit of DV). IMO since peris has taken it through the criminal courts, if SKD was found not guilty then he'd have some decent proof that there was no DV. As a result, she could be entitled to less in the separation agreement if it goes that way (you get more if there was DV and the onus of proof isn't all that high IMO).

That's my rambling... all theoretical, possibly all BS and obviously I haven't read SKD's charges or the statement of facts (or seen any of the evidence). I always like to have a ramble though
